Frequently asked questions
- Can a non-US resident own a US LLC?
- Yes. There is no citizenship or residency requirement to own a US LLC. You do not need an SSN, and you do not need to travel to the United States to form one.
- Which state should I choose?
- Wyoming suits most founders on cost, privacy and low annual obligations. New Mexico offers anonymity with no annual report. If you have US employees or a physical presence, the calculus changes and we will tell you so.
- How is a non-resident US LLC taxed?
- A single-member LLC with no US-source income and no US presence is generally not subject to US federal income tax, but it must still file Form 5472 with a pro-forma 1120. Your home-country tax obligations continue to apply and depend on your residency.
- How long does formation take?
- State registration is typically complete within a few business days. The EIN usually takes two to four weeks for non-residents, and banking follows once the EIN is issued.
- Do I need a US address?
- Your registered agent provides the required state address. For banking and business correspondence, a separate US business address is often useful and can be arranged as an add-on.
